The Ever Changing Telemedicine Laws
Patients in some states could be allowed to establish a relationship with a physician through real time audiovisual technologies instead of face to face visits, this is under a proposed policy raised the State Medical Board Telemedicine Advisory Committee.
Under previous laws and regulations, patients had to meet with a doctor in person first before considering the telemedicine option.
The Telemedicine Advisory Committee is coming up with a regulation that will be presented to the board to try bring some changes to existing laws and regulation that hinder the delivery of health via telemedicine.
The committee came to an agreement to allow patient doctor relationship to be established as long as the patient provides detailed medical information to the physician and gives informed consent, and as long as the physician agrees to take responsibility for the patient’s health care. The physician must be licensed by the state but is not required to be located in the state.
The committee agreed that the initial relationship should be established only through real-time audio and visual communication.
The committee agreed that doctors who practice telemedicine should not prescribe controlled substances. However, prescriptions for other drugs can be issued.
According to the committee’s recommendations, a doctor should be record a patient’s history during their initial contact. They should provide a record of the encounter to the patient and send a copy to the patient’s primary care provider if the patient allows. If necessary, physicians should refer patients to an appropriate local provider, such as an emergency room or family doctor.
As the health industry continue to change daily, a reduction of clients in some areas have been noted. Many independent doctors and physicians are opting to join groups and hospital institutions that have already satisfied the terms of existing regulations and laws thanks to the assistance of telemedicine attorneys.
With the relaxation of previous regulations and policies, health institutions and health care providers should work closely with telemedicine attorneys to see they comply with new rules and regulations in order to provider legal services to patients in different parts of the country and World. These expert lawyers can represent a telemedicine business in the court of law if they faced charges and they can also help such institution get the correct licenses. Telemedicine lawyers can also help patients if they are injured while following the advice or medication given through telemedicine services.
